El artículo analiza el alcance penal y constitucional de la Sentencia No. 67-23-IN/24 de la Corte Constitucional del Ecuador sobre eutanasia activa y muerte digna. La pregunta de investigación es: ¿cómo debe interpretarse el artículo 144 del Código Orgánico Integral Penal después de la constitucionalidad condicionada declarada por la Corte y qué lineamientos normativos se derivan para evitar tanto la punición inconstitucional como la desprotección de personas vulnerables? Se emplea una metodología cualitativa, jurídico-doctrinal y documental, basada en análisis normativo, jurisprudencial, comparado y bibliográfico. El estudio sostiene que Ecuador no se encuentra ante un vacío absoluto ni ante una criminalización absoluta: el homicidio permanece tipificado, pero no se sanciona al médico que practique eutanasia activa cuando concurran consentimiento inequívoco, libre e informado, o intervención representativa en los casos admitidos, y sufrimiento intenso derivado de lesión corporal grave e irreversible o enfermedad grave e incurable. Se distinguen eutanasia activa, suicidio médicamente asistido, rechazo de tratamiento, adecuación del esfuerzo terapéutico, sedación paliativa y cuidados paliativos. A partir de experiencias de Colombia, España, Países Bajos y Bélgica, se identifican salvaguardas prudentes: evaluación clínica independiente, consentimiento reiterado, información completa, oferta efectiva de cuidados paliativos, revisión interdisciplinaria, registro, auditoría, transparencia y objeción de conciencia individual no obstructiva.

This article analyzes the criminal and constitutional scope of Judgment No. 67-23-IN/24 issued by the Constitutional Court of Ecuador regarding active euthanasia and the right to a dignified death. The research question is: how should Article 144 of the Comprehensive Organic Criminal Code (Código Orgánico Integral Penal – COIP) be interpreted following the "conditioned constitutionality" (constitucionalidad condicionada) declared by the Court, and what normative guidelines emerge to prevent both unconstitutional punishment and the lack of protection for vulnerable individuals? The study employs a qualitative, legal-doctrinal, and documentary methodology based on normative, jurisprudential, comparative, and bibliographic analysis. The study contends that Ecuador is facing neither a legal vacuum nor absolute criminalization: homicide remains a codified offense, yet physicians who perform active euthanasia shall not be prosecuted provided there is unequivocal, free, and informed consent (or surrogate intervention in authorized cases) and intense suffering resulting from serious and irreversible bodily injury or a serious and incurable disease. A distinction is drawn between active euthanasia, medically assisted suicide, refusal of treatment, limitation of life-sustaining treatment (LST), palliative sedation, and palliative care. Drawing from the experiences of Colombia, Spain, the Netherlands, and Belgium, the article identifies prudent safeguards: independent clinical evaluation, repeated consent, comprehensive information, effective provision of palliative care, interdisciplinary review, mandatory registry, auditing, transparency, and non-obstructive individual conscientious objection.
