El consentimiento del titular del bien jurídico plantea desafíos relevantes en el derecho penal ecuatoriano debido a la ausencia de una cláusula general que regule expresamente sus efectos sobre la antijuridicidad. El objetivo del estudio fue analizar si el consentimiento puede operar como causa justificante y establecer criterios interpretativos aplicables al ordenamiento ecuatoriano. Se desarrolló una investigación cualitativa, jurídico-doctrinal y documental, basada en el examen del Código Orgánico Integral Penal, la Constitución, jurisprudencia nacional e internacional, instrumentos de derechos humanos y bioética, derecho comparado y doctrina especializada. Los resultados evidenciaron una omisión normativa expresa, aunque la noción de “justa causa” prevista en el artículo 29 permite considerar excepcionalmente la eficacia del consentimiento respecto de bienes jurídicos disponibles. Se identificaron como criterios esenciales la disponibilidad del bien, capacidad y libertad del titular, información suficiente, proporcionalidad material y ausencia de prohibición expresa. Se concluye que el consentimiento puede excluir excepcionalmente la antijuridicidad cuando concurren requisitos estrictos, sin extenderse a bienes indisponibles como la vida o las lesiones graves, garantizando así seguridad jurídica y una interpretación penal restrictiva.

The consent of the holder of the legal interest poses significant challenges in Ecuadorian criminal law due to the absence of a general clause expressly regulating its effects on unlawfulness. The objective of the study was to analyze whether consent can operate as a justifying ground and to establish interpretive criteria applicable to the Ecuadorian legal framework. A qualitative, legal-doctrinal, and documentary research was conducted, based on the examination of the Comprehensive Organic Criminal Code, the Constitution, national and international case law, human rights and bioethics instruments, comparative law, and specialized scholarship. The results revealed an express normative omission; however, the notion of “just cause” provided for in Article 29 allows for the exceptional consideration of the effectiveness of consent regarding disposable legal interests. The essential criteria identified were the disposability of the interest, the capacity and free will of the holder, sufficient information, substantive proportionality, and the absence of express prohibition. It is concluded that consent can exceptionally exclude unlawfulness when strict requirements are met, without extending to non-disposable interests such as life or serious injury, thereby ensuring legal certainty and a restrictive criminal interpretation.
